By Hossam Badrawi"},"content":{"rendered":"<p>Every civilization is tested at the moment when two legitimate rights come into conflict.<\/p>\n<p>On one side stands the investor, who has risked capital, knowledge, and years of effort to create something new.<\/p>\n<p>On the other stands the human being whose life may depend on gaining access to that innovation\u2014or to the knowledge that leads to it.<\/p>\n<p>At that point, the issue is no longer merely economic, legal, or medical.<\/p>\n<p>It becomes an ethical question about the kind of civilization we aspire to build.<\/p>\n<p><strong>Where does the investor&#8217;s right end, and where does the human right begin?<\/strong><\/p>\n<p>I am liberal in my political philosophy and believe in market economics. At the same time, I am a social liberal: in both political and economic practice, I place human rights at the forefront of my thinking.<\/p>\n<p>I believe the private sector plays an indispensable role in the economy and should not have to compete with state-owned enterprises. The state&#8217;s role is to regulate, legislate, and oversee\u2014not to compete in the marketplace.<\/p>\n<p>Yet the true challenge to liberal thought emerges in areas such as education, healthcare, public transportation, social security, and, to varying degrees, access to housing and pensions.<\/p>\n<p>Early in my political life, I did not perceive these distinctions as clearly as I do today. These are not merely services to be purchased according to one&#8217;s financial means. They are fundamental rights that should be available to every person, regardless of wealth or social status.<\/p>\n<p>Beyond the responsibilities of the state itself, education and healthcare are not favors granted by governments or markets. They are universal human rights that should never be compromised, regardless of political ideology.<\/p>\n<p>Perhaps no field better illustrates the delicate balance between market principles and human rights than the pharmaceutical industry. It is an industry driven by investment, risk, and innovation, yet it deals with the most precious thing any person possesses: life itself.<\/p>\n<p>This raises an urgent question:<\/p>\n<p><strong>How do we protect investors without denying patients? How do we preserve innovation without delaying knowledge?<\/strong><\/p>\n<p>This brings me to the central subject of this article: the pharmaceutical industry and the protection of scientific knowledge.<\/p>\n<p>Not every battle surrounding medicine is a battle between illness and healing.<\/p>\n<p>Some of the most consequential struggles are far less visible, yet they may shape the future of humanity more profoundly.<\/p>\n<p>Among them is a question that resurfaces with every major medical breakthrough:<\/p>\n<p><strong>Does scientific knowledge belong to those who discover it, or to those whose lives depend upon it?<\/strong><\/p>\n<p>Recently, there has been a growing trend toward restricting international competitors&#8217; access to certain clinical research findings, justified as a means of protecting innovation and preventing exploitation\u2014particularly amid intensifying competition with China.<\/p>\n<p>The rationale is understandable.<\/p>\n<p>Major pharmaceutical companies invest tens of billions of dollars in research programs that often span fifteen years or more. They begin with an idea conceived in a laboratory and, if successful, culminate in a new medicine. Between those two points lie thousands of failed experiments whose costs are borne entirely by the companies themselves.<\/p>\n<p>Without strong intellectual property protection, incentives to invest would diminish, innovation would slow, and ultimately everyone would lose.<\/p>\n<p>But does the discussion end there?<\/p>\n<p>I believe it begins there.<\/p>\n<p>This debate is not about stealing a drug formula, manufacturing counterfeit medicines, or violating patent rights.<\/p>\n<p>It concerns something fundamentally different.<\/p>\n<p>It concerns making scientific knowledge available so that other researchers can replicate studies, expand upon them, and test them across larger patient populations and more diverse genetic and ethnic backgrounds, thereby accelerating the path toward more reliable conclusions.<\/p>\n<p>In medical science, replication is not a redundant exercise.<\/p>\n<p>It is one of the essential foundations of scientific certainty.<\/p>\n<p>A result demonstrated only once is never sufficient.<\/p>\n<p>A result independently reproduced across multiple countries, among diverse populations, and by different research teams is what ultimately becomes reliable scientific knowledge.<\/p>\n<p>At this point, it is important to distinguish between two concepts that are often confused: <strong>ownership<\/strong> and <strong>knowledge<\/strong>.<\/p>\n<p>Ownership is inherently exclusive. What belongs to me cannot simultaneously belong to someone else.<\/p>\n<p>Knowledge is fundamentally different.<\/p>\n<p>The more widely it is shared, the stronger it becomes. Every researcher who builds upon existing knowledge expands humanity&#8217;s capacity to generate new discoveries.<\/p>\n<p>Here lies the dilemma:<\/p>\n<p>Should scientific knowledge\u2014knowledge that may save millions of lives\u2014be treated in the same way as any other commercial asset?<\/p>\n<p>This leads to a profound philosophical question:<\/p>\n<p><strong>Does restricting scientific information protect innovation&#8230; or does it delay knowledge?<\/strong><\/p>\n<p>Some would argue that limiting competitors&#8217; access to research data gives companies more time to recover their investments.<\/p>\n<p>From an economic perspective, they may well be right.<\/p>\n<p>From a public health perspective, however, time itself may be the price.<\/p>\n<p>Every month that delays the development of a more effective treatment may represent thousands of patients who never receive the opportunity to recover.<\/p>\n<p>This is the paradox.<\/p>\n<p>What protects investment may postpone saving lives.<\/p>\n<p>What accelerates knowledge may reduce financial returns.<\/p>\n<p>Which right should take precedence?<\/p>\n<p>I do not believe the answer lies in choosing one while sacrificing the other.<\/p>\n<p>Innovation requires protection.<\/p>\n<p>Medical knowledge requires openness.<\/p>\n<p>The solution is not to abolish intellectual property rights but to distinguish between two issues that are too often conflated.<\/p>\n<p>The first is the right to temporary commercial exclusivity\u2014a legitimate legal protection designed to encourage innovation.<\/p>\n<p>The second is the claim to exclusive ownership of scientific knowledge itself.<\/p>\n<p>Here the issue becomes considerably more complex.<\/p>\n<p>Knowledge capable of saving millions of lives is unlike any ordinary commodity.<\/p>\n<p>A medicine is not a new smartphone.<\/p>\n<p>It is not software.<\/p>\n<p>It is not a more advanced automobile.<\/p>\n<p>It concerns human life itself.<\/p>\n<p>For this reason, medical ethics has long rested upon a fundamental principle: life-saving knowledge should circulate rather than remain confined, while fully respecting the legitimate rights of those who generated it.<\/p>\n<p>The COVID-19 pandemic taught us that viruses recognize no borders.<\/p>\n<p>Science, too, should encounter no more barriers than justice truly requires.<\/p>\n<p>If research teams around the world were able to work simultaneously with the same scientific data, we might reach answers more quickly, discover new therapeutic uses for existing medicines, shorten years of research, save billions of dollars, and\u2014most importantly\u2014save lives that might otherwise be lost while the world waits.<\/p>\n<p>Nations may fear losing their scientific advantage to competitors.<\/p>\n<p>Companies may fear declining profits.<\/p>\n<p>Yet we should never forget that the primary purpose of medicine has never been to maximize financial returns.<\/p>\n<p>Its purpose is to reduce human suffering.<\/p>\n<p>For that reason, I believe the future lies neither in choosing innovation over knowledge nor knowledge over innovation.<\/p>\n<p>Rather, it lies in building a more intelligent global framework capable of achieving both.<\/p>\n<p>A framework that fully protects innovators&#8217; intellectual property and their rightful economic returns while also enabling the responsible sharing of scientific knowledge, the replication of research, and structured international collaboration under clear legal safeguards against commercial misuse.<\/p>\n<p>There is a profound difference between stealing innovation&#8230;<\/p>\n<p>and accelerating knowledge.<\/p>\n<p>Between counterfeiting a medicine&#8230;<\/p>\n<p>and hastening the discovery of scientific truth.<\/p>\n<p>In the end, humanity will continue to confront the same question with every new scientific breakthrough:<\/p>\n<p>When saving a human life depends upon scientific knowledge, does that knowledge remain private property\u2014or does it become part of humanity&#8217;s shared heritage?<\/p>\n<p>Will we measure the success of science by what it earns for investors&#8230;<\/p>\n<p>or by the lives it saves?<\/p>\n<p>Perhaps true civilization begins the day we learn how to achieve both.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Every civilization is tested at the moment when two legitimate rights come into conflict. He called on the government to listen and respond to their demands. Consequently and due to Dr. Badrawi's popularity, Mubarak appointed him as the NDP Secretary General thus replacing the members of the Bureau of the Commission. During that time, Dr. Badrawi expressed his political opinion to Mubarak that he had to step down. He had to resign from the party after 5 days of his appointment on February 10 when he declared his political disagreement with the political leadership in dealing with the demonstrators who called for handing the power to the Muslim Brotherhood. Therefore, from the very first moment his stance was clear by rejecting a religion-based state which he considered as aiming to limit the Egyptians down to one trend. He considered deposed president Mohamed Morsi's decision to bring back the People's Assembly as a reinforcement of the US-supported dictatorship. He was among the first to denounce the incursion of Morsi's authority over the judicial authority, condemning the Brotherhood militias' blockade of the Supreme Constitutional Court. He was against extending the state of emergency and objected to the National Democratic Party's unilateral constitutional amendments during the January 25, 2011 revolution. He played a very important political role when he defended, from the very first beginning of the revolution, the demonstrators' right to call for their demands. He called on the government to listen and respond to their demands. Consequently and due to Dr. Badrawi's popularity, Mubarak appointed him as the NDP Secretary General thus replacing the members of the Bureau of the Commission. During that time, Dr. Badrawi expressed his political opinion to Mubarak that he had to step down. He had to resign from the party after 5 days of his appointment on February 10 when he declared his political disagreement with the political leadership in dealing with the demonstrators who called for handing the power to the Muslim Brotherhood. Therefore, from the very first moment his stance was clear by rejecting a religion-based state which he considered as aiming to limit the Egyptians down to one trend. He considered deposed president Mohamed Morsi's decision to bring back the People's Assembly as a reinforcement of the US-supported dictatorship. He was among the first to denounce the incursion of Morsi's authority over the judicial authority, condemning the Brotherhood militias' blockade of the Supreme Constitutional Court.
